Terms of Service
New England Jazz Collaborative, Inc.
Effective date: May 29, 2026
1. Agreement to these Terms
These Terms of Service (“Terms”) govern your purchase of tickets, registration for events, reservations, and donations made through the ticketing site operated by New England Jazz Collaborative, Inc. (“NEJC,” “we,” “us,” or “our”), a 501(c)(3) nonprofit organization registered in Massachusetts.
By completing a checkout, RSVP, reservation, or donation, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the ticketing site.
2. Tickets, RSVPs, and Reservations
We offer several ways to attend our events:
- Paid tickets. You pay the listed price at checkout. A per-transaction payment processing fee may be added and shown to you before you pay.
- Free RSVPs. No payment is collected. Your RSVP holds your spot.
- Card-secured reservations. No payment is collected up front. We securely save a payment method to hold your reservation. You are only charged if a no-show fee applies, as described in Section 4.
Tickets and reservations are for personal use. We may limit the number of tickets per order or per person, and we may refuse or cancel orders that appear fraudulent, abusive, or in violation of these Terms.
3. Cancellations and Refunds
- Paid tickets are final. Unless an event is canceled or postponed by NEJC (see Section 6), paid ticket purchases are non-refundable.
- Card-secured reservations and free RSVPs may be canceled at any time before the cancellation deadline shown on your order and in your confirmation email, using the “manage your order” link in that email.
- When a refund applies (for example, where we offer one at our discretion or as required by law), the refund is the amount you paid minus non-refundable payment processing fees, returned to your original payment method.
- Partial cancellations (canceling some but not all seats in an order) are reviewed by NEJC staff and handled case by case.
- Donations are never refundable (see Section 5).
4. Card-Secured Reservations and No-Show Fees
Some events let you reserve a spot without paying up front by securely saving a payment method (“card-secured reservation”). For these reservations:
- You are not charged when you reserve. We save your payment method only to enforce the no-show policy below.
- You may cancel for free any time before the cancellation deadline shown on your reservation. If you cancel by the deadline, you will not be charged.
- No-show fee. If you do not cancel by the deadline and do not attend, a no-show fee may be charged to your saved payment method. The fee amount is disclosed on the reservation and in your confirmation email, and is charged per reserved seat that was neither canceled nor used.
- Human review before any charge. No-show fees are never charged automatically. NEJC staff review each case before any charge is made, and may waive the fee at their discretion.
- If a charge fails (for example, your bank requires additional authentication, or your card has expired), we may email you a secure link to complete the payment, and we may re-attempt the charge.
- Add-ons, tips, and donations purchased alongside a card-secured reservation are handled separately and are not refunded as part of a no-show charge.
By creating a card-secured reservation, you authorize NEJC to charge the saved payment method for the disclosed no-show fee under the conditions described above.
5. Donations
Donations made through the ticketing site are voluntary and separate from ticket purchases. NEJC is a 501(c)(3) nonprofit organization; donations are tax-deductible to the extent allowed by law. You will receive a donation acknowledgement that includes our EIN and the information required for your records.
Donations are non-refundable, including when an associated order or reservation is canceled or refunded.
6. Event Changes, Postponements, and Cancellations
Events may be rescheduled, relocated, or canceled. If NEJC cancels an event, confirmed orders for that event are refunded (excluding donations, which you may instead choose to let us keep as a gift). If an event is postponed or rescheduled, your tickets or reservations remain valid for the new date unless we tell you otherwise.
We are not responsible for personal expenses (such as travel or lodging) you incur in connection with an event that is changed, postponed, or canceled.
7. Payments
Payments are processed by Stripe, Inc. We do not collect or store your full card number on our systems. Your use of payment features is also subject to Stripe’s terms and privacy policy. By submitting payment information, you represent that you are authorized to use the payment method.
8. Admission and Conduct
Admission to an event is a revocable license. NEJC and its venues may refuse entry to, or remove, anyone who behaves disruptively, unsafely, or in violation of venue rules or applicable law, without refund. Venues may have their own policies (including age, bag, and recording policies) that apply to your visit.
9. Privacy
Information you provide through the ticketing site is handled in accordance with our Privacy Policy. Please review it to understand what we collect and how we use it.
10. Disclaimers
The ticketing site is provided “as is” and “as available.” To the fullest extent permitted by law, NEJC disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, secure, or error-free.
11. Limitation of Liability
To the fullest extent permitted by law, NEJC and its officers, directors, employees, volunteers, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or goodwill, arising out of or related to your use of the ticketing site or attendance at an event. To the fullest extent permitted by law, our total liability for any claim relating to a ticket, reservation, or donation will not exceed the amount you paid to NEJC for the order giving rise to the claim.
Nothing in these Terms limits liability that cannot be limited under applicable law.
12. Changes to these Terms
We may update these Terms from time to time. Changes take effect when posted on this page, and the “Effective date” above will be updated. Your continued use of the ticketing site after changes are posted means you accept the revised Terms.
13. Governing Law
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-laws rules. Any dispute relating to these Terms or the ticketing site will be brought in the state or federal courts located in Massachusetts.
